Terms of Service

1. Acceptance of Terms

By accessing or using Flyover Map 3D (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

2. Description of Service

Flyover Map 3D provides tools to generate 3D map visualizations and related media outputs based on user-provided inputs and data.

We may modify, suspend, or discontinue any part of the Service at any time without notice.

3. Eligibility

You must comply with applicable laws regarding age in your jurisdiction to use the Service.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

We reserve the right to suspend or terminate accounts at our sole discretion, including for violations of these Terms.

5. Payments, Credits, and Billing

Payments are processed by Stripe.

• Credits are granted upon successful payment and have no cash value.
• Credits are non-transferable and non-refundable except where required by law.
• You are responsible for any applicable taxes.
• We reserve the right to modify pricing at any time.

Chargebacks or fraudulent payments may result in immediate suspension or termination of your account.

6. User Content

You retain ownership of the data, files, and inputs you provide to the Service (“User Content”).

By using the Service, you grant us permission to process and use your User Content solely for the purpose of operating, maintaining, and improving the Service.

We do not claim ownership of your User Content. You remain responsible for ensuring that your content complies with applicable laws and does not violate the rights of others.

7. Generated Outputs

The Service may generate videos, maps, or other outputs based on your inputs (“Outputs”).

• Outputs are provided “as is” without warranties of any kind.
• While we aim to provide useful and accurate results, we do not guarantee accuracy, completeness, or reliability.
• Outputs are intended for general informational and visualization purposes and should be independently verified before being relied upon in real-world decisions.

You may use, reproduce, modify, and distribute Outputs for any lawful purpose, including commercial use.

You are solely responsible for how you use the Outputs.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to systems or data
• Interfere with or disrupt the Service
• Upload or process content that infringes intellectual property or privacy rights

9. Intellectual Property

All rights, title, and interest in the Service (excluding User Content and Outputs) are owned by Flyover Map 3D.

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

10. Service Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We are not responsible for data loss, service interruptions, or system failures.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

Upon termination, your right to use the Service will immediately cease.

12. Limitation of Liability

To the maximum extent permitted by law, Flyover Map 3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

13. Indemnification

You agree to indemnify and hold harmless Flyover Map 3D from any claims, damages, liabilities, and expenses arising from:

• Your use of the Service
• Your User Content
• Your use of Outputs
• Your violation of these Terms

14. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
